North East Link Project

Design work is underway for North East Link – the single biggest transport infrastructure investment in Victoria’s history. North East Link will finally build the missing link in Melbourne’s freeway network while increasing the capacity of the Eastern Freeway.

Who may be affected?

Up to 215 properties across suburbs including Greensborough, Yallambie, Rosanna and Bulleen will be compulsorily acquired for the link, which will connect the ring road in Greensborough to the Eastern Freeway in Bulleen. The map below illustrates the areas the may be affected by the project.

What has happened so far?

Construction on North East Link is already well underway, with a massive early works program realigning the Yarra East main sewer using three mini-TBMs, and work is well progressed to relocate more than 34km of gas water, sewer pipes, drains, and over 96 other utilities to make way for North East Link.

Who may be affected?

According to media reports, about 75 houses and 140 businesses that sit within the North East Link’s proposed route may be affected.

If your property is within the project foot print you would have likely already been notified by the North East Link Authority stating that your property will be compulsory acquired as part of the project.

Throughout 2018 the authority will be continuing the design of the North East Link and working on the specialist studies required for planning approvals, the outcome of such work could result in additional properties being acquired as part of the project.

FAQs

It is often overlooked that legal and other professional expenses are generally recoverable from the acquiring authority as a matter of right. This assists our clients in seeking our advice as property experts from the outset to assist with any concerns and strategy. We also have a strong connection with various external consultants that will assist in understanding your position, such as valuation and strategic planning advice.

If your property is identified as being within the ‘project area’, the formally designated area where compulsory acquisitions will occur, the Noth East Link Project will likely seek to engage with you. If you wait too long, it may impact your ability to ensure you are in the best position to ensure your right to compensation. This is why the earlier you contact us the more likely we can ensure your rights can be maintained. Unfortunately, if you want until receiving the formal notification of intention to acquire, it may be too late.

A claim for compensation usually involves complex mechanics that are best understood only through extensive experience. This is what sets us apart from other firms. Our experience assists us in advising you in the strategic and legal processes to obtain the outcome that is best for you. This includes that you may be entitled to an upfront advance on any offer made without prejudicing the claim.

Having one of Victoria’s richest histories in representing clients in land acquisitions, we have been involved in every major and local transport project throughout Victoria, acting only for claimants. This includes, more recently, the North East Link Project, West Gate Tunnel Project, Metro Rail Project, Level Crossing Removal Projects and now the Suburban Rail Loop. We have represented and advised a range of clients include owners, businesses, owners corporations and other affected parties, and understand not only the legal implications but also the emotion and practical realities. We therefore aim to give advice on all aspects of how you will be affected.
